Analysis of the Book “The Bad Laws”

One of our collaborators, has asked us to do an analysis of the book “The Bad Laws (and the way out)” by Alberto Mansueti 2009.

We will do this analysis, with the purpose of seeing that we can take from this work, both what contributes to our proposal, either to add, to improve or to correct. Given that we start from the idea that we can be wrong, not that we are the possessors of absolute truth.

This analysis is quite critical and straightforward, as these complicated themes, require that the differences be exposed as clearly as possible, in order to make them simple for the general public.

Which In We Agree?:

• The current society no longer serves, none of its systems, neither political, nor economic, educational, health, social security, judicial or electoral.
• The solution to the problems of society starts with the participation of its citizens, and without them will not be possible the changes that we must do. That is, your participation, dear reader, is very important.
• The state has grown enormously.
  • It deals with many functions of society that it should not.
  • It sacrifices the freedom of citizens under the promise of greater security, resulting in loss of freedoms without gaining more security.
  • It is inefficient in what it does.
  • It tends to corruption.
  • Obstacles the development of new companies.
  • It favors large companies, monopolies and oligopolies.
  • It is closely related to the banking system, favoring and securing its monopoly on the country’s money.
• In order to work on solutions for society, one must be well prepared in multiple areas of knowledge, one must know history, psychology, philosophy, economics, mathematics, law, sociology, science and even religion and spirituality.
• In the vision that weapons must be accessible to all citizens, and not exclusively to the state and crime.
• The reality that the human being, needs goals beyond materials, needs spiritual goals to make sense of his life.

Let us now turn to the proposals made in this book.

What We Can Take for Our Proposal?:

The vision that the laws of the country, must be re-elaborated, to guide them to the country plan. Since in our book “Society of Mutual Welfare” we do not touch the important issue of the laws, and Alberto Mansueti, develops it quite well.

We must analyze the proposal of Alberto Mansueti, to eliminate laws by standard contracts, this we have to think well, since we would be changing a formal laws, by some informal laws established by these contracts. This would give more discretion to the Judges, which is a gateway to corruption.

Also in terms of laws, it is necessary to be clear, in that it’s impossible to make a complete and perfect law. This we know of the “godel’s incompleteness theorem”.

We propose a mixture of these two visions using the benefits of modern technologies of collective participation, direct democracy. In this way we can have dynamic laws, containing a series of principles that change little, established by the legislative body (the assembly), and a whole body of details established in standard contracts, periodically reviewed by a group of legislators.

This body of details or standards contracts is proposed and modified by the collective on the internet. As is the development of “open source” software where thousands of people contribute changes, which are debated, argued and consolidated in stable versions. In this way we will have laws that are updated according to the changing reality, we will have laws more interactive and fast.

What We Do Not Agree ?:

• Our main proposal in SBM “Society of Mutual Welfare” is the change of the educational system, fundamental point to develop the new society. We can have the best design of society, but with uneducated citizens, this will become a disaster like the one we currently have. On the other hand, if we have a poor design of society, like the present one, but with educated citizens, these soon will arrange their society.
• We differ from other proposals, current and past, in which we start from the change of man to change society. Those who have sought to change society to change man are the same ones who have invented all theisms of the past, socialism, communism, capitalism, and so on.
• We define educated citizens, those who have two qualities: 1- are intelligent, analytical by themselves. 2- are sensitive to other citizens and nature.
• Individualism can´t be more important than the collective. The human being is both individual and collective, and we must seek a balance between these two parts. The best example is the human body. The cells of the human body are individual and collective, and for them to function well, and all have everything they need, they must work in the collective good, which leads to individual well-being. Therefore we can´t go to an extreme and defend only individual well-being.

What Can We Contribute to the Model of Alberto Mansueti ?.

• The two laws of economics, which we write in our article money-economy-and-finance, which in a compact way describe what he likes about capitalism.
• Our economic model, capitalism without capital, described in our book SBM “Society of Mutual Welfare”.
• Our educational principles, described in our book.
• Our social security model, which takes into account the reality, that almost no human work is needed to produce the goods and services we require.
• Our business model, which does not have the social charges since these are of society and not of the company, making that we are in total harmony with the laws of the economy.
• The proposal to base education on values. In the values ​​produced by the scientific observation of the human being, without the contamination of local morality. Morality is left as a local culture, which must be preserved or not, for the conscience of individuals.
• Our model of conflict resolution, using the technique of circles, is called in our book “round table”.
• Our model of indicators for goods and services (which is a reorganization of great work on indicators of Christian Felber), as well as the products have a label that says its ingredients and caloric inputs, we propose that all products are labeled with 3 indicators : economic, social and ecological. In this way we also apply direct democracy, allowing each citizen to vote with his money on each product.

Final Words

We thank the author, Alberto Mansueti, for his excellent work “Las Leyes Malas”, which is an excellent document, to feed the discussion, of what the new society should be. It is a work very rich in knowledge and wisdom, with a very valuable Christian approach. Writing books like this, require a great deal of dedication, which should be commended.
